Child Abuse, Abandonment, and Neglect: Mandatory Reporting Guidelines

Policy Overview

The personal safety and welfare of each child is of paramount concern to the Caldwell School District Board of Trustees, employees, and patrons. District employees must be thoroughly educated on their legal and ethical responsibilities regarding the observation and reporting of suspected child abuse, abandonment, or neglect.

Statutory Definitions (I.C. § 16-1602)

Abuse

Conduct or omissions resulting in skin bruising, bleeding, malnutrition, burns, bone fractures, subdural hematoma, or soft tissue swelling.

Includes sexual conduct (rape, molestation, incest, prostitution, obscene/pornographic depiction) or other sexual exploitation harming health, welfare, or mental wellbeing.

Abandonment

Failure of a parent to maintain a normal parental relationship, including reasonable support or regular personal contact.

Failure to maintain this relationship without just cause for one (1) year is evidence of abandonment. (I.C. § 16-1602(2))

Neglect

A child who is without proper parental care, control, subsistence, education, medical, or other care necessary for well-being due to conduct, omissions, neglect, or refusal by parents or guardians. (I.C. § 16-1602(25))

Staff Guidance for Responding to Suspicion

Do Not Question or Investigate: School district employees are not trained investigators and do not possess proper equipment for evidence collection. Do not interview or question the student. To preserve rules of evidence, only official, trained investigators from the police department or CPS/Department of Health and Welfare should conduct interviews.
"Reason to Believe" standard: You only need a suspicion ("reason to believe") that abuse occurred to make a report. You do not need proof.
Never Examine or Photograph Injuries: Never force a child to show an injury or remove clothing to view an injury. Do not take pictures of a child's injury under any circumstances.
Direct Reporting is Required: While you may share suspicions with a school counselor, social worker, nurse, psychologist, or administrator, doing so does not relieve you of your legal duty to report. Second or third-party reporting is not as effective as a direct report from the person who observed the issue or spoke with the student.
Strict Confidentiality: Discuss the case strictly on a need-to-know basis. Only share information with necessary parties, which may include the building administrator, school counselor, school nurse, the Department of Health and Welfare, and local police.

Steps for Mandatory Reporting

1. Notify Building Leadership Immediately: Notify your building administrator or building designee immediately regarding the situation.

2. File the Official Report (Within 24 Hours): The mandated reporter with the most direct knowledge must call local law enforcement or the Idaho Department of Health and Welfare. (The building administrator/designee may be present during the call.)

3.Document the Report: Use the district reporting form (Form 5260F: Report of Suspected Child Abuse, Abandonment, or Neglect) to document all phone calls made to the police and Child Protection Services.

Immunity, Liability, & Penalties

Immunity for Good Faith Reporting (I.C. § 16-1606)

Any person who reports suspected abuse, abandonment, or neglect in good faith pursuant to Idaho Code § 16-1605 is immune from civil or criminal liability.

False Reporting & Bad Faith (I.C. § 16-1607)

Reporting in bad faith, with malice, or knowing allegations are false removes immunity. Violators are liable for actual damages or statutory damages of $500 (or treble damages if malice/oppression is proven), plus attorney fees and court costs.

Failure to Report

Any employee who fails to report suspected abuse or prevents another from reporting may be held civilly liable, is guilty of a misdemeanor, and is subject to disciplinary action up to and including termination of employment.
